  1. Principles of personal data processing

Unterberghornbahnen Gmbh & CoKG takes data protection very seriously. We treat your personal data as confidential and according to legal data protection provisions and to the following privacy statement. Data processing is subject to the legal provisions of §96 para 3 of TA and Art. 6 para 1 lit a of GDPR (legal basis: consent or legitimate interest). You can use our website without sharing information about your person. No personal data will be collected unless you explicitly provide that information to us. However, personal data may be collected from you on a voluntary basis for some particular purposes or services (e.g. name, address or e-mail address). If you send us a contact form or an email, we will record the data you shared with us for a period of six months and we will not pass it on to any third party without your prior consent.
Please note that there may be safety gaps concerning Internet data transfer (e.g. e-mail communications).Total protection of the data from third party access is not possible. This statement  refers to data that are shared with us when visiting our website and informs you about the handling of data. 

We process your data on lawful basis and bona fide. The persons concerned will be informed about the collection and the planned use of their personal data.

Data is collected and processed based on defined, unequivocal and legal purposes. Data will exclusively be collected and processed as stated in this agreement.

You have the right to be informed about the personal data we collect.

If the personal data we collected is inaccurate or incomplete, you have the right to obtain from the controller without undue delay the rectification of inaccurate personal data concerning you.

Right to erasure:

You have the right to obtain from the controller the erasure of personal data without undue delay, if the collection or processing was unlawful. There may be reasons that do not allow the immediate erasure of personal data. (obligation to preserve records or further legal provisions)

Right to restriction of processing:

You have the right to obtain from the controller restriction of processing if the accuracy of the personal data is contested by you, for a period enabling the controller to verify the accuracy of the personal data, if the processing is unlawful and you oppose the erasure of the personal data and request the restriction of their use instead, if the controller no longer needs the personal data for the purposes of the processing, but they are required by you for the establishment, exercise or defence of legal claims or if you have objected to processing.

Right to data portability:

You have the right to receive the personal data concerning you in a machine-readable format if the processing is based on consent or on a contract.

Right to object:

If  processing of your personal data is necessary in order to protect your vital interests or processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority, you have the right to object on grounds relating to your particular situation unless the controller demonstrates compelling legitimate grounds for the processing.

Right to complain:

If you think that the processing of your data infringes privacy law or that your data protection claims are violated, please contact us. If we cannot clear the situation you are entitled to lodge a complaint with the data protection authority in Austria (Wickenburggasse 8, 1080 Wien, dsb@dsb.gv.at, www.dsb.gv.at) or any other competent EU authority.

1.3. Job application privacy notice

The controller collects and processes personal data of job applicants for the purpose of carrying out the recruiting process. Electronic processing is possible, especially if the applicant sends the application documents electronically, e.g. by e-mail or by a website form. If the data controller concludes an employment contract with the applicant, the transferred data is stored for the purpose of carrying out the employment relations pursuant to legal provisions. If no employment contract is concluded the application documents are deleted automatically two months after job refusal unless there are legitimate interests opposing erasure of data, such as burden of proof in a legal dispute based on General Equal Treatment Act (GETA).

2.1. IP Address

When visiting our website some information is automatically stored at the web server, such as browser, system software, which page directed you to our website, your IP address, time of access and further information. This data is pseudonymised and cannot be allocated to an individual without further data sources. Unterberghornbahnen do not evaluate these data unless the web site is used illegally.

2.2. COOKIES

Our website uses so-called cookies. They do not cause any harm to your computer and do not contain viruses. Cookies are used to make our offer user-friendly, more effective and safer. Cookies are small text files which are placed on your computer and stored by your browser. Most of the cookies used are “session cookies”.  They are automatically deleted after the visit on the website. Other forms of cookies stay on your computer until you delete them. This website uses Google Analytics, a web analytics service provided by Google, Inc. The information generated by the cookie about your use of the website (including your IP address) will be transmitted to and recorded by Google on servers in the United States. This website uses Google Analytics with the extension “anonymized”. 2.4. Accommodation inquiries and bookings

If you book an accommodation with  Bergbahnen Kössen, Kaiserwinkl Tourism Association collects data necessary for the booking of the respective lodgings such as your name, telephone number, e-mail address (“contact data”) as well as date of your arrival and departure, your hotel and type of your booked lodging (“booking data”).

How we share your data?
If you book on our website, your booking data is transferred to feratel Deskline booking tool (Feratel Media Technologies AG guest data bank and booking tool) and shared with the respective accommodation provider to make your booking possible. Your data is not shared with any other third parties. The tourism association does not sell or lease your contact data. We may disclose your personal information to government authorities or other relevant third parties in order to comply with applicable legal requirements, judicial proceedings, court orders, legal process, or lawful requests from governmental authorities.

2.5. NEWSLETTER

When you sign up to receive Unterberghornbahnen newsletter, we collect and process following personal data: title, name and surname as well as your e-mail address. You then agree to obtain regular personalised e-mails including customised information and offers of the provider (= newsletter). By subscribing to our newsletter, you accept the use of your data for regular newsletter notification pursuant to Art. 6 para 1 lit a GDPR.

You can unsubscribe from the newsletter any time. By clicking at the link at the end of the newsletter you can unsubscribe from the newsletter. You can also send a respective e-mail to koessen.newsletter@skisport.com. After unsubscription your personal data will be deleted from the newsletter list within six months. 

2.6. Competitions/ surveys

Occasionally our website collects visitors' data  when we conduct temporary activities such as competitions, surveys etc. You always take part on a voluntary basis and you decide whether you want to share personal data or not. Types of data collected may be personal data (such as name, e-mail address, phone number, demographic data (e.g. postal code, age group) or other forms of data. The data is used to provide you with our services. The data is stored for the duration of the competition no longer than 36 months and will then be deleted. By taking part at the competition you agree that in the event of winning a price your name will be published on our website and on social media canals (only Facebook for the time being). For certain competitions and surveys further terms of use and data processing apply and will be explicitly stated and complete the statement mentioned above. We will never sell or lease your contact data.

This website contains links to other webpages. Please note that we assume no liability for data protection and content of external websites.  

PRIVACY STATEMENT FOR THE USE OF FACEBOOK PLUGINS (LIKE BUTTON)

Our website uses several plugins provided by  Facebook, Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA. You can easily recognise the plugin marked with the blue „F“ Facebook logo. By interacting with plugin functions e.g. by activating the like button this information is directly sent to and stored at Facebook. We have no control over what data this plugin collects and how it is used by the provider. Please refer to the privacy policy of Facebook. If the user is not located in the USA or Canada the responsible authority for personal data processing is Facebook Ireland Ltd., 4 Grand Canal Square, Grand Canal Harbour, Dublin 2, Ireland. PRIVACY STATEMENT FOR THE USE OF YOUTUBE

Our website uses plugins provided by YouTube, a service by Google. The provider of YouTube is YouTube, LLC, 901 Cherry Ave., San Bruno, CA 94066, USA. When you visit one of our pages with a YouTube plugin you are automatically connected to the YouTube server. YouTube will be informed about which of our pages you have visited. If you are logged in to your YouTube account YouTube can directly allocate your surfing activities to your profile. You can prevent it by logging out of your YouTube account. OBJECTION TO ADVERTISING E-MAILS

We hereby object to the use of the contact data published in our legal notice for sending us unsolicited advertising e-mails and information brochures. The provider of this website explicitly reserves the right to take legal action in the event of receiving unsolicited advertising material by spam e-mails etc.

CHANGES TO OUR PRIVACY STATEMENT
