Right of Withdrawal Policy
A customer who is a consumer as defined by the Consumer Protection Act has the right to cancel this contract within 14 days without providing a reason. The cancellation period is 14 days from the day
- on which the consumer or a third party designated by the consumer, who is not the carrier, took possession of the goods;
- OR (in the case of a contract for multiple items ordered in a single order and delivered separately) on the day the consumer or a third party designated by the consumer, who is not the carrier, took possession of the last item;
- OR (in the case of a contract for the delivery of a single item in multiple partial shipments or pieces) on the day the consumer or a third party designated by the consumer—who is not the carrier—took possession of the last partial shipment or the last piece.
If this right of withdrawal is exercised within the specified time limit, the consumer is no longer bound by the order. The date on which the notice of withdrawal or the goods were sent to the company is decisive for the exercise of the right of withdrawal.
The right of withdrawal must be exercised by sending it to:
Hinterstoder-Wurzeralm Bergbahnen AG
Hinterstoder 5a, A-4573 Hinterstoder
Tel. +43 7564 5275
Fax +43 7564 5275 130
Email: info@hiwu.at
by means of a clear statement (e.g., a letter sent by mail or an email) regarding the decision to withdraw from this contract.
To meet the withdrawal deadline, it is sufficient to send the notice of exercising the right of withdrawal before the withdrawal period expires. However, the right of withdrawal does not apply if the performance of the service has already begun within the withdrawal period. Furthermore, when purchasing season passes or ski tickets that are valid for a fixed period, there is no right of withdrawal pursuant to Section 18(1)(10) of the Distance and Off-Premises Sales Act.
Consequences of Withdrawal:
If this contract is withdrawn from, the company must refund all payments it has received from the customer, including delivery costs, without delay and no later than fourteen days from the day on which the company received notice of the withdrawal from this contract. For this refund, the Company will use the same payment method that the consumer used for the original transaction, unless expressly agreed otherwise with the consumer; under no circumstances will the consumer be charged any fees in connection with this refund. The Company may withhold the refund until it has received the goods back or until the consumer has provided proof that the goods have been returned, whichever occurs first. The consumer must return or hand over the goods to the company without delay and, in any case, no later than 14 days from the day on which the consumer notified the company of the cancellation of this contract. The deadline is met if the consumer ships the goods before the 14-day period expires. The consumer bears the direct costs of returning the goods. Please handle the goods with care. You may inspect them as you would in a store. If the goods are used beyond what is necessary for inspection or are damaged and thereby lose value, a reasonable compensation for the loss in value may be charged.
