Grossglockner Bergbahnen Touristik GmbH

These General Terms and Conditions apply to all current and future services provided in connection with the purchase of tickets and access authorizations by guests (customers). In addition, the terms and conditions of transportation and use of the respective lifts and pistes apply.

The individual ski areas and facilities are provided by legally independent companies. These companies operate their respective cable car and lift facilities as well as ski slopes and ski routes independently and on their own responsibility. The purchase of a ticket entitles the passenger to use the facilities covered by the ticket. However, the actual transportation contract is only concluded with the cable car or lift company whose facilities and ski slopes and ski routes the guest is currently using.

Any liability towards passengers, whether based on contractual or statutory provisions, for incidents arising from or during the operation and use of the cable car and lift facilities as well as ski slopes and ski routes shall therefore be borne exclusively by the cable car or lift company(s) in whose ski area the incident occurs. Any liability towards the contractual partners, whether based on contractual or statutory provisions, for incidents arising from or during the operation and use of the facilities (incl. slopes and ski routes) is therefore expressly the responsibility of the company in whose area the incident occurs. Outside the winter season, the purchase of a ticket only entitles the holder to use the lifts (depending on the ticket, ascent and/or descent). The use of the ascent facilities (cable cars and lifts) requires the possession of a valid ski pass. The mountain railway company does not owe the holder of a valid ski pass any transportation if transportation is impossible or inadmissible for reasons for which the mountain railway company is not responsible. Such reasons include weather-related influences (e.g. strong winds) as well as downtimes due to prescribed maintenance, technical faults, official orders, force majeure (such as unrest, epidemics, pandemics or similar).

In addition to the General Terms and Conditions, the respective terms and conditions of transportation and use of the individual cable car or lift companies also apply.

 

1. general

By using a valid ticket, a transportation and piste use contract is concluded between Grossglockner Bergbahnen Touristik GmbH and the user. The customer hereby expressly accepts the general terms and conditions set out here, as well as the respective terms and conditions of transportation and use of Grossglockner Bergbahnen Touristik GmbH, whose facilities he/she uses. This also applies in particular to the tariff regulations, the price lists and the officially approved conditions of carriage of the individual facilities according to the respective notice. A breach of the conditions of carriage or general terms and conditions, the disregard of complete or partial closures of ski runs and facilities as well as the repeated failure to follow the instructions of the employees of Grossglockner Bergbahnen Touristik GmbH may result in exclusion from any transportation and the withdrawal of the ticket or season ticket without compensation and, if necessary, a criminal complaint to the competent authority.

The same applies in the event of intentional damage to property belonging to Grossglockner Bergbahnen Touristik GmbH or dishonorable or corrupt behavior to the detriment of Grossglockner Bergbahnen Touristik GmbH.

The valid ski pass entitles the holder to access the Grossglockner/Heiligenblut ski area during the published winter season times. Night and special rides are excluded.

 

2. tickets

Grossglockner Bergbahnen Touristik GmbH offers hourly, daily and multi-day tickets as well as season tickets.

With regard to season tickets, it should be noted that the start and end dates of a season announced in advance are not "fixed dates" and depend on various factors such as the weather.

The purchase of a valid ticket is possible without exception at the Grossglockner Bergbahnen Touristik GmbH ticket offices and sales machines, online via www.gross-glockner.at and any partners. Proper identification is required to claim a special rate. To purchase a season ticket, an ID and a photograph are required, which the purchaser must bring with them. Proof of age and family status is also required in order to receive the family bonus for children. Tickets and proof of eligibility for any special rates must be presented to Grossglockner Bergbahnen Touristik GmbH staff and inspectors on request.

The ticket is non-transferable, subsequent exchange for another ticket and changes to the period of validity are not possible. Tickets that have not been purchased at the above-mentioned points of sale, lost tickets and tickets that have been improperly purchased or used will be blocked. Any misuse of a ticket will also result in the levying of a fine of twice the price of the day ticket and a criminal complaint to the competent authority.

When purchasing ski tickets, € 5.00 will be charged per ticket issued as an insert for the KeyCard. This amount will be refunded when the ski pass is returned at the ticket office. No refunds are possible for damaged tickets. The KeyCards must not be exposed to excessive heat and must not be bent or perforated.

The access facilities must be used properly. Insurance cover under the Cable Car Act only applies to persons with a valid ticket.

 

3. webshop

Tickets can be purchased in the online store (www.gross-glockner.at). Access authorization can be obtained by collecting tickets from the ticket machine or at the ticket offices.

A booking can only be made after all mandatory fields in the booking window have been entered completely and correctly. The customer is solely responsible for entering the data correctly.

The customer acknowledges that the order process can no longer be canceled or reversed once the payment button has been pressed.

The electronic confirmation (e-mail confirmation) from Grossglockner Bergbahnen Touristik GmbH serves as the only admissible proof that the booking has been made correctly and must therefore be carried by the customer and presented at the operator's cash desk together with the booked data carrier in the event of a complaint.

Payment in the online store is made by credit card (Visa or Mastercard) or DebitCard. The amount will be charged immediately to your credit card or debited immediately from your account.

The booked service can be used at the earliest 30 minutes after receipt of the confirmation of execution when an existing KeyCard is recharged. From this point in time, the activation of the data carrier is generally effective on all access control systems in the booked ski area.

A malfunction of a ski pass must be reported immediately at the nearest ticket office. Subsequent complaints regarding function and billing cannot be considered.

We request that the dates of birth of children, young people and senior citizens are entered correctly - age checks are carried out in the ski area!

Please note that reduced tickets (disabled persons from 60 %, ski instructors) and snowman tickets can only be issued at the ticket offices as before!

 

4. loss of tickets

In principle, lost tickets will not be replaced. The loss of a ticket whose holder is registered by name (season tickets) can be reported to the Grossglockner Bergbahnen Touristik GmbH ticket offices. Upon presentation of the original purchase receipt and proof of identity and payment of a processing fee of € 25.00, a new ticket can be issued. The lost ticket will be blocked.

No replacement tickets can be issued without presentation of the proof of purchase.

 

5 Refunds

A refund is only possible in the event of skiing accidents for ski passes with a validity period of 2 days or more. Refunds are made from the day following the last day of use or from the first day after the accident at the earliest. The receipt and a medical certificate from a doctor or hospital in the region must be presented. Refunds can be obtained in the ski region in which the ski pass was purchased.

Separate regulations apply to the reimbursement of season tickets (Sunny Card and Carinthian ski pass).

The following general provisions also apply to hourly, day and multi-day tickets, as well as the SunnyCard and Carinthian Ski Pass:

Non-utilization of a ticket due to bad weather, avalanche danger, unforeseen departure, illness, operational disruptions and interruptions, closure of ski lifts (ski runs), closure of entire lifts, closure of individual lifts and all lifts for whatever reason, premature cessation of lift operations or similar shall not entitle the holder to a refund or extension of the validity period. In particular, the cessation of operations due to force majeure, official orders due to technical, health (pandemic, epidemic and similar) or other reasons, do not entitle to a refund or extension of the validity period, unless this closure was caused by gross negligence on the part of Grossglockner Bergbahnen Touristik GmbH.

 

6. rescue of injured persons

The rescue of injured persons is organized by Grossglockner Bergbahnen Touristik GmbH and carried out in cooperation with its partners, provided the injury occurs during operating hours. In relation to the rescue effort, a cost reimbursement will be charged.

 

7. piste reservations

In principle, slope reservations are only possible subject to availability. The confirmation of such a reservation is at the sole discretion of Grossglockner Bergbahnen Touristik GmbH. The reservation of individual pistes for training and racing events must be made in writing. A corresponding agreement must be signed by the customer and returned to Grossglockner Bergbahnen Touristik GmbH. If there is no signed agreement, no pistes will be made available.

In order to ensure safe and unhindered customer traffic, any placing and setting up of objects or aids (in particular also teaching/learning aids) as well as the placing, drilling of poles, barriers etc. outside the reserved and actually assigned slopes, slope sections or other partial areas is prohibited.

When placing poles and barriers within the allocated areas, these may only be anchored in the snow cover and not drilled into the ground. When leaving the reserved piste section, it must be cleared of all objects and aids, poles and barriers etc. that have been placed or erected, so that the piste/track can be used again safely and unhindered by customers.

8. fun sports/special facilities

The usability of special ski areas may be partially or completely restricted. These restrictions do not entitle the customer to a refund, price reduction or extension of the use of the ski ticket.

 

9. equipment hours

In the event of unscheduled use of our employees using snow groomers or skidoos/quads, the applicable rates shall apply. A minimum of 20 minutes will be charged at the currently valid hourly rate for all use of equipment.

 

10. transportation of goods and animals using mountain railways

A fee is charged for the transportation of goods. Liability claims for transport damage are excluded.

The transportation of animals also requires the purchase of a ticket and the animals must be kept appropriately.

Dogs are generally required to be kept on a lead in the ski area and must be kept on a muzzle during transportation and in enclosed areas of all facilities. The owner of the animal is jointly and severally liable for any personal injury or damage to property.

 

11. special trips

In the case of special trips, special arrangements can be made with Grossglockner Bergbahnen Touristik GmbH or after consultation with the management, but only if at least five people are to be transported. Separate rates apply for these special trips.

 

12. skidoo/quad rides

The operation of skidoos/quads on the slopes of Grossglockner Bergbahnen Touristik GmbH is only permitted with the consent of the landowner and Grossglockner Bergbahnen Touristik GmbH, which must be obtained by the skidoo operator himself; if necessary, official approval must also be obtained. Skidoos/quads must be in perfect technical condition, warning and emergency stop devices must be fitted accordingly. The driver must have the appropriate training and instruction as well as any necessary official permits. The operator of the skidoos/quads must ensure that it is not possible for unauthorized persons to operate them. In the event of damage to property or personal injury, liability lies exclusively with the operator of the skidoos/quads.

 

13. ski tourers

For safety reasons, ski touring on the Grossglockner Bergbahnen Touristik GmbH pistes is only permitted at the edge of the piste.

 

14. paragliders

Paragliding launches are only permitted in the area designated by the respective cable car or lift company.

Only pilots with a valid paragliding license, approved and liability-insured aircraft and a valid day or season ticket are entitled to take off. Take-offs and landings are only permitted in the designated areas. Landing is expressly prohibited on all ski slopes. All legal height and distance regulations must be observed.

Failure to comply with these regulations may result in a ban on flying and/or transportation.

 

15. lockers/ski depot

Grossglockner Bergbahnen Touristik GmbH may offer the use of lockable lockers/ski depots as a service for a corresponding fee. The opening hours depend on the opening hours of the lift operation. Grossglockner Bergbahnen Touristik GmbH accepts no liability whatsoever for lost items or damage arising in connection with the use of the lockers/ski depots.

 

16 Liability

The liability of Grossglockner Bergbahnen Touristik GmbH for property damage and financial losses arising in connection with the use of the lift and piste facilities is excluded in the event of slight negligence.

The operators of the lift facilities are in no way responsible for items lost by the customer in the ski area. In the event of possible soiling of clothing when using the lift facilities, the operator has no obligation to make amends.

Any liability towards customers, whether based on contractual or statutory provisions, for incidents arising from or during the use of the lift and piste facilities shall be borne exclusively by the lift company in whose ski area such an incident occurs. There is no liability for other lift companies that use the same lift pass. The specific transportation contract is only concluded with the lift company whose lift and piste facilities the customer is using at the time of the incident.

 

17 Commercial and advertising activities

All commercial and advertising activities on facilities, pistes and ski runs as well as parking areas of Grossglockner Bergbahnen Touristik GmbH must be expressly approved by Grossglockner Bergbahnen Touristik GmbH. The installation of advertising boards, panorama cameras and other advertising may only take place with the consent of Grossglockner Bergbahnen Touristik GmbH. Violations may also result in exclusion from transportation and withdrawal of the ticket without compensation as well as a police report. (see point 2)

 

18. data processing

By concluding the contract of carriage, the customer gives his express consent that the data provided by him to Grossglockner Bergbahnen Touristik GmbH, which are necessary for the execution and processing of the services of Grossglockner Bergbahnen Touristik GmbH, may be processed and stored within the legal framework of the GDPR. Only data that is absolutely necessary for the provision of services by Grossglockner Bergbahnen Touristik GmbH or that the customer provides voluntarily is requested. Consent to the use of this data can be revoked in writing at any time.

Furthermore, the customer gives his express consent for the data entered by him when booking to be stored and processed in order to carry out the booking and payment process. This data may also be compared with external systems for control purposes. The customer also agrees to this data being passed on to the partner companies within the framework of the statutory provisions and restrictions (GDPR). The customer's attention is drawn to the fact that this consent can be revoked at any time. The customer has the option of creating data transmission via secure data connections (SSL) in their own area. The companies involved transmit at least the data required for payment processing via secure data lines.

The customer expressly agrees to the transmission of the payment confirmation to the payment system and - after the payment has been approved - to the debiting of the invoice amount due in each case using the direct debit authorization procedure for the selected payment method.

All companies involved in the booking process are subject to telecommunications secrecy and GDPR obligations.

When tickets are booked, the data entered is processed electronically. The customer is informed by e-mail about new services and ski offers. This service is free of charge and can be canceled at any time.

The protection of customers' personal data is ensured by appropriate organizational and technical precautions. These precautions relate in particular to protection against unauthorized, unlawful and also accidental access, processing, loss, use and manipulation.

However, Grossglockner Bergbahnen Touristik GmbH accepts no liability whatsoever for the disclosure of information due to errors in data transmission and/or authorized access by third parties not caused by Grossglockner Bergbahnen Touristik GmbH. The data will not be stored for longer than is necessary to fulfill the contractual or legal obligations and to defend against any liability claims.

 

19. information on the reference photo

Please note that for the purpose of access control, a reference photo of the lift ticket holder is taken when passing through a turnstile equipped with a camera for the first time. This reference photo is compared by the lift staff with the photos that are taken each time the person passes through a turnstile equipped with a camera.

The reference and comparison photos are deleted after the expiry of the validity of the lift ticket + offset time.

It should be noted that it is also possible to purchase lift tickets at a surcharge of 50% of the normal price, which are technically configured so that no photo is taken when passing through the turnstile, but random checks by the lift staff must be expected.

Strict checks are carried out using electronic readers at the access points in the ski area. Tickets must be presented to the lift staff for inspection on request. All ski passes are non-transferable. Any misuse of ski passes, including their use by third parties or the use of incorrect age categories, will be punished and will result in the withdrawal of the ski pass without compensation (subject to the charging of a fine or the filing of a criminal complaint). The card owner is obliged to keep his ski pass safe and any loss or theft must be reported immediately. The resale or transfer of ski passes and vouchers is strictly prohibited.

 

20. photo information

For the purpose of documenting and presenting our activities, photos and video recordings are made during events either by us or by photographers commissioned by us, which are published on our website, in social media channels and in print media as part of our public relations work in order to give our business partners and customers as well as interested persons an insight into our activities and to increase our level of awareness. We base the processing of this data on our legitimate interest within the meaning of Article 6(1)(f) GDPR and Sections 12 and 13 FADP, taking into account proportionality. The recordings made are made available to the public through publication on our website, in social media and in print media. These recordings will not be used for any other purpose. The data will also not be passed on to recipients who pursue their own purposes with this data. The data will not be transferred by the controller to third countries. The image and video recordings are stored until the end of the third year after their last use, as only then can it be assumed that they are no longer required for the purpose of processing. Individual images, in particular those of public figures, may be stored for longer for archiving purposes.

The examination of a request for deletion in individual cases remains unaffected by this. As a data subject, you have the right to information, rectification, erasure, restriction of processing, objection and data portability within the scope of the statutory provisions. 21 Other provisions

In addition to the General Terms and Conditions, the General Terms and Conditions of Carriage of the respective facilities shall apply. The customer undertakes to take note of these in advance and not to violate them and to follow the instructions of the respective lift personnel. In particular, the special transportation regulations for children under 14 years of age or under a height of 110 cm must be observed.

Furthermore, it is pointed out that leaving the prepared and designated routes and slopes (e.g. also deep snow and mogul slopes) as well as skiing on the adjacent forest areas is strictly prohibited. Any violation is punishable by law (§ 33 Forestry Act); furthermore, Grossglockner Bergbahnen Touristik GmbH accepts no liability for any resulting damage.

A basic distinction must be made between ski slopes, ski routes and open terrain.

Ski slopes are prepared, marked and secured against avalanches and atypical dangers.

In general, all our ski slopes are closed from 17:00 in the evening and 09:00 in the morning for safety reasons.

Ski routes are not groomed, but marked and secured against avalanches, but there is no protection against atypical dangers.

The free ski area (freeride area) is unsecured, unmarked and not secured against avalanches or atypical dangers. The stay and skiing (e.g. "freeriding") is at your own risk, the dangers of high alpine terrain prevail.

The FIS piste rules also form part of these General Terms and Conditions and must be complied with by the user of the lift and piste facilities.

Austrian law shall apply. The competent court of jurisdiction is determined at the registered office of Grossglockner Bergbahnen Touristik GmbH.

General Terms and Conditions

for the purchase of lift tickets in the online store

 

1. the contract is concluded with Grossglockner Bergbahnen Touristik GmbH, Hof 94, 9844 Heiligenblut. Only persons over the age of

5. tickets purchased in the online store are only valid once the purchase price has been paid in full. The company also reserves the right to block the validity of tickets in cases of misuse within the scope of automated processing.

 

6. payment in the online store can be made by bank transfer or by credit card (VISA or Mastercard) or DebitCard.

 

7. the information provided will be processed automatically. The Contractual Partner agrees to receive advertising information from the Company.

 

8. the Contractual Partner is obliged to provide the relevant and requested data completely and correctly when concluding the contract. In the event of incorrect, incomplete or unclear information provided by the Contractual Partner, the Contractual Partner shall be liable for all costs and damages incurred by the Company as a result.

 

Right of withdrawal for consumers (does not apply to entrepreneurs)

A customer who is a consumer within the meaning of the Consumer Protection Act has the right to withdraw from this contract within 14 days without giving reasons.
